    The upcoming European Soil Health Law - chances and challenges for an effective soil protection

    The European Soil Strategy for 2030 by the European Commission has set the foundations for an overarching approach to the protection of soils in Europe. In this scientific opinion paper, the German Environment Agency (⥠UBA⥠) lays down its key recommendations for the upcoming Soil Health Law. Feedback on legislative options is provided and experience gained in Germany in the past years on soil protection and restoration is shared. Knowing the outstanding importance of soils for human and ecosystem health, UBA strongly agrees that a new binding European legislative framework on soils with high ambition is urgently needed.     The Position paper begins by discussing options on how to further develop EU soil protection law. Compared to the status-quo, strengthening the existing soil protection legislation at EU level would preserve transboundary ecosystem services of soils and also help to effectively implement the ‘land degradation neutrality’ objective. More specifically, the Position paper clarifies the advantages and disadvantages of the two possible regulatory approaches – the holistic/development concept comparable to the Water Framework Directive on the one hand and the sector-related/minimum requirement approach on the other hand. The Position paper further submits specific proposals for the development of EU Soil protection legislation especially with regard to contamination, land take/soil use as well as agriculture.

    The Sustainable Development Goals - an important milestone on the global soil policy agenda in 2015

    Goals (SDGs) are going to be passed by the United Nations General Assembly. The SDGs are going to be a set ofglobally agreed goals and targets that provide orientation for future development policies. Currently soil aspects areworded in the proposal on the SDGs - even though the wording is overall a minor and partly inconsistent one. TheSDGs will be politically yet not legally binding. Enforcing and broadening the United Nations Convention to CombatDesertification could be an option for a global and legally binding instrument on soil protection. Soils are a crosscutting issue with relevance for environmental, social and economical concerns, equally.     Soil governance: the case of implementation and enforcement

    This chapter focuses on how sustainable soil management provisions could be implemented and enforced. It discusses first how institutional arrangements have to be built up in order to establish effective implementation and enforcement processes. One basic question is which management tasks for soil governance have to be dealt with by governmental entities. Secondly, the chapter outlines how science could contribute to effective legal implementation and enforcement. Thirdly, the involvement of the general public, stakeholders and experts is elucidated. These aspects need to be stressed as being essential and important as reasonable substantive provisions are only "ink on paper" as long as they are not fully implemented and enforced. © 2022 The Author
