Die neue Luftqualitätsrichtline: Gestiegene Anforderungen für bessere Luft in Europa

Abstract

Die Luftqualität in Deutschland hat sich in den letzten Jahren stetig und deutlich verbessert. Zahlreiche Grenzwertüberschreitungen von Feinstaub (PM10) und Stickstoffdioxid (NO2) führten in der Vergangenheit zu umfangreichen Maßnahmen wie Umweltzonen oder Fahrverboten, welche nun kaum mehr notwendig sind. Nun Entwarnung zu geben wäre allerdings falsch: Der wissenschaftliche Erkenntnisstand zur Wirkung von Luftschadstoffen in den geltenden Richtlinien ist circa 20 Jahre alt. Eine Revision schien damit angezeigt: Am 26. Oktober 2022 legte die EU-Kommission ihren Vorschlag für eine überarbeitete Luftqualitätsrichtlinie vor, der im Herbst 2024 förmlich verabschiedet und am 20.11.2024 im Amtsblatt der Europäischen Union veröffentlicht wurde. Die neue Richtlinie 2024/2881 des Europäischen Parlaments und des Rates vom 23. Oktober 2024 über Luftqualität und saubere Luft für Europa (Neufassung) muss nun von allen Mitgliedstaaten bis zum 11.12.2026 in nationales Recht überführt werden. Neben meist strengeren Grenz- und Zielwerten enthält diese Luftqualitätsrichtlinie weitere Neuerungen, die die Verbesserung der Luftqualität in Deutschland und den Mitgliedstaaten der EU auch in Zukunft weiter vorantreiben sollen. Air Quality in Germany has been improving continuously and significantly for the recent years. Due to numerous limit value exceedances of particulate matter and nitrogen dioxide concentrations there were many measures like low emission zones that are hardly necessary any more. Giving all-clear now would be wrong: The scientific knowledge in the current directives on the effects of air pollutants is approx. 20 years old. A revision was therefore necessary. On 26 October 2022 the European Commission propounded a proposal of the revised air quality directive that was adopted in autumn 2024 and published in the Official Journal of the European Union on 20 November 2024 as DIRECTIVE (EU) 2024/2881 of the European Parliament and of the Council of October 2024 on ambient air quality and cleaner air for Europe. All member states have to transpose it into national legislation until 11 December 2026. Besides limit and target values that are mostly stricter than before, this directive provides further innovations that shall drive forward the improvement of air quality in Germany and the other member states of the EU.
